Terms and Conditions1.Non-Discrimination. Broker and Owner agree that, as required by law, discrimination because of race, color, religion, national origin, sex, marital status, age, familial status, or disability of the parties hereto with respect to the sale or lease of this property is prohibited.
2.Termination. Reservations may be terminated 60 days prior to arrival for a full refund. Travel insurance through CSA may be purchased at 6.95% of the rental charge that will cover termination of the contract at anytime for such things as; sickness, injury or death, extension of the school year, armed service leave, or other reasons listed in the policy/certificate of insurance. Agent strongly recommends you purchase CSA Vacation Rental Insurance. By initialing below you are agreeing to purchase CSA Vacation Rental Insurance at a cost of 6.95% of all non-refundable charges on your reservation (which applies to rental funds). Please initial and we will send you the appropriate paperwork____________________
3.Default. If the Guest fails to pay the rent when it is due, or perform any term hereof, the Agency, at their option may terminate all rights of the Guest hereunder, unless the Guest immediately cures such default. If the Guest abandons or vacates the property, while in default of the payment of rent, the Agency may consider any property left on the premises to be abandoned and may dispose of in any manner allowed by the law.
4.Liability. Guest shall defend, indemnity and hold the Owner of the property and Agent harmless from and against any claim, loss or damage to any person or property in or upon the premises or any area allocated to or used by the Guest or its invites, arising out of the Guests use or occupancy of the premises, excepting any intentional or negligent acts on part of the Owner or the Agent.
5.Right of Entry. Agency reserves the right to enter the premises at all reasonable hours of the day for the purpose of inspection, whenever necessary to make repairs and alterations to the premises, or to show the property to prospective purchasers, workman or contractors, with advance notification to the Guest whenever reasonably possible.
6..Renting and Homes for sale. If, after occupancy, the property is damaged through no fault of the renter and is unfit for occupancy, the rental shall terminate and the renter shall surrender possession. The rent will be prorated as of termination. In some cases, the property hereunder is for sale and the title to the property may change before the commencement of the rental under the rental terms and conditions and the new owner may not desire to rent the property for a vacation rental. If the property ownership changes prior to the commencement of the rental of the property to Renter, the Rental Terms and Conditions and the reservation created thereby is not guaranteed and may be terminated. In the event this property is not rentable and the request of the Renter or if the property is removed from the rental market or if the property is sold prior to the commencement of the rental provided for herein and the new owner does not wish to rent the property for a vacation rental, agent reserves the right to substitute for renter’s use under theses rental terms and conditions a property of equal or higher quality than the property or refund the prorated rent to the renter. Renter hereby agrees to hold harmless agent and renter from damages or injuries to person or property by reason of any cause whatsoever either in or about the property or elsewhere.
Assignment of subletting. Guest shall not assign this Agreement or sublet any portion of the premises with-out written consent of the Agency.
7.Repairs or Alterations. Guest shall be responsible for any damages caused by his or her negligence and that of his/her family, guests or invitees. The Guest shall not paint, paper, redecorate or make any alterations to the premises without prior written consent of the Agency. The Agency is not responsible for compensation of any part of rent due to failure of fixtures or appliances resulting in short term inconvenience. All repairs will be attended to as soon as possible. Renters are to make sure furniture, if moved, is back to its proper state.
8.Ordinances and Statutes. Guest shall comply with all statutes, ordinances and requirements of all municipal, state and federal authorities that are now enforced or may hereafter be enforced, pertaining to the use of the said premises.
9..Upkeep of premises. Guest shall keep and maintain the premises in a clean and sanitary condition at all times and upon the termination of the tenancy shall surrender the premises to the Agency in as good condition as when received. Renters may not turn away lawn care, pool/spa maintenance persons, or any individual who helps maintain the property.
10.Utilities. Owner shall be responsible for the payment of all utilities, local phone service and internet, except for long distance, which shall be paid for by guest if used.
11.Swimming pools, hot tubs and saunas. Should the leased premises contain swimming pools, hot tubs and saunas, the Guest agrees to assume full responsibility for the use of the said facilities, accepting any un-intentional, intentional or gross negligent acts on the part of the Contracted Guest, Renters and their Guests.
12.Attorney Fees. In the event of default, by either party in the terms or covenants of this lease agreement, the party deemed to be in default shall be responsible to the other party for all damages caused by the said default including but not limited to, reasonable and actual attorney fees.
13.Insufficient Checks. In the event that a check should not clear, we will secure payment in the form of a cashier check, money order or credit card. There will be a $40 fee for all returned checks.
14.Housekeeping. In the event of excessive abuse to the rental property, requiring additional housekeeping, above what is considered normal, you will be charged $30 per hour.
15.Keys. If you have lost or misplaced the keys to your rental property please notify Dune Grass Rentals before using force to enter the unit. If a new lock is necessary, due to damage by the Guest, there will be a $100 charge for replacement. Please also know that there will be a $25 fee for any unreturned or lost keys.
16..Garbage. If you have excess garbage that will not fit into the provided garbage containers, PLEASE contact our office immediately at 269.231.5199. Thank you!
